Other lawsuits involving babies born with heart defects were filed against GlaxoSmithKline in 2006 and 2007. In all of these cases the mothers had taken Paxil during their pregnancies.
Several Paxil lawsuits have been filed to recover damages for patients who committed suicide while taking Paxil. For example, a Paxil lawsuit was filed in California in 2005 by the grandparents of a 20-year-old man whose symptoms worsened after taking Paxil, until he committed suicide. This Paxil litigation argues that the manufacturer, GlaxoSmithKline, failed to adequately warn about the dangers of increased suicidal thoughts and behavior in patients taking Paxil.
Several Paxil class action lawsuits have been filed to recover damages for injuries caused by this drug. One class action in California has alleged that Paxil causes severe withdrawal symptoms and that that the manufacturer, GlaxoSmithKline, concealed information about those Paxil side effects from the public. The causes of action in that suit include fraud and deceit, negligence, strict liability, breach of warranty and implied warranty. GlaxoSmithKline has settled several Paxil lawsuits, but critics have complained that the settlements have prohibited plaintiffs from revealing information that is needed to ensure people are compensated for the harm done by Paxil.
GlaxoSmithKline has also been accused by governmental entities of illegally interfering with the release of a generic version of the same drug as Paxil, and causing states to pay more for the drug in their health programs. In March 2006 GlaxoSmithKline agreed to pay $14 million in settlement of the dispute, to be divided among the states affected.

Lawsuits filed against Johnson & Johnson over its Ortho Evra birth control patch are being settled for millions of dollars. Legal analysts say that this trend should continue due to the company’s alleged withholding of information that the patch was more dangerous than advertised.
Too much estrogen
Lawsuits filed against Johnson & Johnson allege that the company knew about the dangers of the Ortho Evra, a once-a-week birth control patch that is advertised as being as safe as traditional daily use birth control pills to avoid pregnancy. In particular, the lawsuits allege that the patch caused deep-vein thrombosis, blood clots in the lungs and legs and pulmonary thrombosis which can lead to heart attacks and strokes. At this time, approximately 20 women, including one 17 year old, have died due to the alleged use of the product.
Settlements
Johnson & Johnson has spent nearly $70 million to settle hundreds of the lawsuits so far, according to Bloomberg News, and many more are pending. In fact, it is estimated that approximately 4,000 lawsuits have been filed against the manufacturer. However, as the company continues to settle these lawsuits, more and more women are complaining about the product.
The following complaints were posted on the product review website, www.rateitall.com:
I am 25 years old, do not drink, do drugs, or smoke, and have used Ortho Evra since 2004. I recently suffered a pulmonary embolism as a result, with blood clots in both lungs which almost killed me. Had it not been for the extreme pain in trying to breathe or move, I wouldn’t have gone to the ER and would have died. PLEASE GET OFF THIS DRUG TO SAVE YOUR LIFE!
I would rate this patch a zero. Ladies stay clear away!!! It ruined my life. I tried it out because I thought it was great since I hated taking pills. I was on it for 2 months when I started getting very bad chest pains. One day my fiancée rushed me to the hospital, because my chest hurt so bad I couldn’t breathe and almost passed out. I screamed and cried in pain. When at the hospital, I found out through a CT of the chest that I had bi-lateral pulmonary embolisms in my lungs (blood clots) I was hospitalized for over a week.
I got SO SICK only a couple days after putting on the patch. I got extremely dizzy, nauseous, and weak. I was sweating and having trouble breathing. As soon as I took it off, my symptoms started clearing up within hours. I would never recommend it to anyone!

The consumer group, Public Citizen, nonprofit consumer advocacy organization, has asked Congress to pull Johnson & Johnson’s birth control patch, Ortho-Evra, off the market because it poses significant health risks to women.
Too much estrogen?

The consumer group says that Johnson & Johnson’s birth control patch, which is worn for three weeks straight, then not worn for a week, delivers 60 percent more estrogen than traditional birth control pills – which significantly increases a woman’s risk of developing blood clots that may result in a heart attack or stroke. It points to studies that show women using the Ortho-Evra patch were twice as likely to develop blood clots.
Although Johnson & Johnson maintains that the patch is safe if used as directed, the following warning appears on the drug’s website (www.orthoevra.com):
Hormones from ORTHO EVRA get into the blood stream and are processed by the body differently than hormones from birth control pills. You will be exposed to about 60% more estrogen if you use ORTHO EVRA than if you use a typical birth control pill containing 35 micrograms of estrogen. In general, increased estrogen may increase the risk of side effects. The risk of venous thromboembolic events (blood clots in the legs and/or the lungs) may be increased with ORTHO EVRA use compared with use of birth control pills.
Studies examined the risk of these serious blood clots in women who used either ORTHO EVRA or birth control pills containing one of two progestins (levonorgestrel or norgestimate) and 30-35 micrograms of estrogen. Results of these studies ranged from an approximate doubling of risk of serious blood clots to no increase in risk in women using ORTHO EVRA compared to women using birth control pills.
Sales of the patch have decreased significantly in the past few years due to damaging studies and the U.S. FDA’s (Food and Drug Administration) enhanced labeling requirement that tell users of the patch’s potential dangers and clarifies that the patch must be used exactly as directed to avoid injury.

Johnson & Johnson’s Ortho Birth Control Patch was supposed to provide the same amount of estrogen as birth control pills. At least that’s what Johnson & Johnson told the U.S. FDA (Food and Drug Administration) at first.
Years later, documents have surfaced showing that J&J’s Ortho Evra birth control patch actually delivers much more estrogen than birth control pills and has an increased risk of causing blood clots and strokes. Injured women have sued J&J, but the manufacturer is simply pointing its corporate finger at the FDA.
Catch 22?
The FDA is responsible for consumer safety regarding foods, drugs and medical devices. In many cases, manufacturers are not held responsible for their products if the FDA takes responsibility for approval – regardless of whether the product is later found to be dangerous or cause injuries. It’s a catch 22 known as preemption.
Preemption
Preemption prohibits consumers from filing lawsuits against manufacturers. However, consumer advocate groups say that the FDA actually relies on manufacturers’ data in approving many products – especially drugs. In fact, the FDA has said as much itself and claims that it does not have the resources to adequately protect consumers. Industry analysts say that manufacturers know this and use it to their advantage – then claim that consumers are preempted from suing them. Unfortunately, this claim has been upheld.
Supreme Court upholds preemption
The U.S. Supreme Court, the nation’s highest court, recently upheld a preemption argument earlier this year. In February 2008, the Court ruled that consumers could not sue medical device manufacturers if the FDA was responsible for approving the device. The Court will hear another case later this year concerning preemption and drug manufacturers and only time will tell how the Court will rule.
Where does that leave consumers?

Ortho Evra is a contraceptive patch used by approximately 4 million women since 2002, when it first went on sale. The patch contains estrogen at levels that are 60% higher than the pill and, as Ortho McNeil has itself disclosed, this higher level of estrogen poses a greater risk for blood clots and other serious side effects than previously disclosed to women who use it. Blood clots are an accepted risk of birth control pills because estrogen is a known blood coagulant. However, while Ortho McNeil maintains that the patch is as safe as the pill, FDA records show that before the patch was approved for release, the FDA had already noted that incidences of non-fatal blood clots caused by the patch were three times higher than that of the pill.

FDA records show that seventeen patch users between the ages of 17 and 30 have suffered fatal heart attacks, blood clots, and possible strokes in the past two years. Dozens more were allegedly affected by the patch, but survived according to 16,000 drug reports filed with the FDA. On November 11, 2005, the FDA announced approval for updated labeling of the Ortho Evra contraceptive patch product. The new labels warns doctors and patients that the patch contains more estrogen than most birth control pills. This warning is important because higher levels of estrogen mean higher levels of risk. The FDA is, at this time, unwilling to ban the product.

Several lawsuits have been filed by families of women who died of or suffered from blood clots while using the patch. The family of a 14-year-old girl who died claim that she was the youngest victim of the patch. A suit by 10 women was filed in 2005, and in 2006 a suit by more than 40 women who claimed hundreds of other suits was filed.
