My fiancé and I want to move out of the state for a better job. Do I have to inform the biological father of the pending move? We have no formal court order regarding child custody or support. He has not seen his daughter since birth, or contributed any money.

Inform Biological Father Child Custody

My fiancé and I want to move out of the state for a better job. Do I have to inform the biological father of the pending move? We have no formal court order regarding child custody or support. He has not seen his daughter since birth, or contributed any money.

You have to tell him that you intend to move. It makes no difference that he hasn’t seen the child or paid child support; you can’t take a child across State lines without consent or an order of the court.

You need to get an attorney to Petition the court for orders of custody, child support arrearages, continuing child support, visitation rights, and whether you can take the child to another State. If you move without consent or an order of the court, plan on returning to the court sometime in the future.
